GENERAL TERMS AND CONDITIONS OF SALE All items sell “AS IS, WHERE IS” with no guarantees or warranties expressed or implied. All purchases are considered verified by the purchaser as to grade and authenticity. The purchaser will rely solely on his/her own judgment in any purchase. PREVIEW: The firearms may be inspected on Friday, June 26, 2009 from 4:00 p.m. to 7:00 p.m. and Saturday, June 27, 2009 from 9:00 a.m. until 12:00 noon at Bryan & Sons, 1010 Ty Ty Omega Rd., Tifton, GA. For other inspection times during the days of June 22-25, call Ronnie Reagin at 229-891-8638. TERMS FOR FIREARMS (other than Class III firearms): All firearms sales are subject to Federal Firearms Regulations. Purchasers will be required to complete all necessary forms in order to facilitate firearm transfers. Firearms will be transferred by Arthur Richter, Baell Mercantile, 550 1st Street, NE, Moultrie, Georgia (a licensed FFL dealer) for a fee of $25.00 per firearm. All firearms sales will be subject to purchaser’s criminal background check. Purchasers with a Federal Firearms Licsense or current Georgia Firearms License are exempt from background checks. Certified copies of documents must be presented at pickup. PICKUP OR SHIPPING OF FIREARMS (other than Class III firearms): All firearms (except Class III firearms) must be picked up at Baell Mercantile Co., 550 First Street, NE, Moultrie, Georgia 31768, (229) 985-5151 between July 1, 2009 and July 15, 2009 from 9:00 a.m. until 4:00 p.m. Firearms not picked up by July 15, 2009 are subject to a $10.00 per day storage fee. Purchasers are required to have a paid invoice for purchase and copies of Federal Firearms License or Georgia Firearms License (handgun permit). All firearms not picked up in person will be shipped by FFL dealer to FFL dealer via UPS. Charges for shipping and handling long guns are $40 per gun and $80 per handgun. FEES DO NOT INCLUDE INSURANCE. NO FIREARMS WILL BE SOLD TO BIDDERS NOT COMPLYING WITH THESE REQUIREMENTS. ALL OUT OF STATE PURCHASES OF HANDGUNS MUST TRANSFER TO A LICENSED DEALER IN THEIR RESPECTIVE STATE. SHIPPING AND ADDITIONAL CHARGES WILL BE THE RESPONSIBILITY OF THE PURCHASER. NAME OF PERSON RECEIVING THE FIREARMS: ___________________________ DRIVER’S LICENSE #: _____________________________ NAME OF FFL BUSINESS: ________________________________________________ NAME OF PERSON SIGNING THE FFL AND THIS CERTIFICATION: ___________________________________________________ TITLE: _____________________________ DATE OF SIGNATURE: ______________________________ NOTARY PUBLIC: ___________________________________ MY COMMISSION EXPIRES: ________________________________ SEAL: TERMS FOR CLASS III FIREARMS: All purchasers of Class III firearms will be required to complete all Ownership Requirements as required by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) before taking possession of the firearms. The requirements for “Individual Ownership” include, but are not limited to, the following: 1) Be a US citizen at least 21 years old 2) Be of sane mind 3) Not an abuser of drugs or alcohol 4) Have never been convicted of a felony 5) Pay a $200 Federal Transfer Tax on each weapon purchased 6) Fill out BATF Form 4 (Application for Tax Paid Transfer and Registration of Firearm) and Certification of Compliance with 18U.S.C. 922 (g)(5)(B) Proof of Citizenship 7) Fingerprints, passport size photos, and a “sign-off” from your local chief law enforcement officer 8) Any other procedures as required by ATF. PAYMENT: Purchasers will make payment in full, which includes bid price, buyer’s premium, sales tax, and transfer fees payable in the form of cash, cashier’s check, credit card or wire transfer. A 10% Buyer’s Premium will be added to the bid price for purchasers settling with cash, cashier’ check, or wire transfers. A 13% Buyer’s Premium will be added to the bid price for purchasers settling with credit cards. Dealers buying for resale may be exempt form paying sale stax if the dealer has the sale tax number and executes the sale tax exemption form. In the event the purchaser is not approved by ATF to purchase a Class III firearm, purchaser shall receive a refund of his purchase price less a default fee of $500.00. Purchasers must submit all required ATF forms and documentation to seller no later than July 7, 2009 and must receive approval to transfer no later than October 15, 2009. PICKUP/SHIPPING OF CLASS 3 FIREARMS: Once seller notifies purchaser of approval to transfer firearms by ATF, purchaser shall have 10 days from notification to pickup or ship firearms. After 10 days the seller may charge a $10.00 per day storage fee. All non-Georgia residents must have firearms picked up by or shipped to a Federal Firearm Licensed Dealer for Class III firearms. SHIPPING AND HANDLING FEES: All firearms will be shipped by FLL dealer to FFL dealer via UPS. Shipping and handlilng fees are payable to FFL dealer in advance. Shipping and handling charges for long guns are $40.00 per long gun. Handguns must be shipped overnight. Shipping and handling charges for handguns are $80.00 per handgun. THESE FEES DO NOT INCUDE INSURANCE. |
